Justice Given To Dr. Rajan Mahtani After Waiting For A Decade, Court Of Appeal Provides The Same
After battling the case of Portland Cement for almost a decade, Dr. Rajan Mahtani finally receives justice. However, this justice came from a different court and not the same court wherein the case was initially established. Dr. Rajan Mahtani first initiated the case at the Lusaka High Court, claiming illegal takeover of his factory. After several court proceedings, final results from Lusaka High Court came. However, these results were controversial as it was announced that Ventriglias were only shareholders of Portland Cement.
This controversial Lusaka HC decision was countered by Dr. Mahtani at the Court of Appeal. Justice Mwinde delivered the final judgement on behalf of the Court of Appeal on 31st January 2019. This was a comparatively quicker judgement compared to the dragged court pendency’s at Lusaka HC. The final decision was awarded only after justice Mwinde evaluated all evidences and testimonials submitted with respect to the case. According to this final decision, Dr. Rajan Lekhraj Mahtani owned Finsbury Investments came to own 58 percent Portland Cement factory shares. On the other hand, the Ventriglias came to own just 42 percent Portland Cement shares. Based on this shareholding pattern, it is established that Dr. Mahtani is actual owner of the Portland Cement Zambia factory.
After this decision was announced, justice Mwinde further cleared various speculations around other aspects associated with the case. All allegations of forgery established in the court were discarded as it was found that mechanically placing signatures was a common practice in Zambia. Justice Mwinde from the Court of Appeal further confirmed a timeline of three months for completing share regulation-related processes.
