Dr. Rajan Lekhraj Mahtani Shares Details Of Final Court Of Appeal Results
Dr. Rajan Lekhraj Mahtani is finally happy and satisfied with the results of the Portland Cement Zambia case, coming from the higher Court of Appeal. Despite registering the case more than a decade ago, Dr. Rajan Lekhraj Mahtani was not given due justice from the Lusaka High Court. The judge at Lusaka HC, justice Nkonde, gave a very controversial decision when he announced Ventriglias as only shareholders of Portland Cement. This statement was extremely controversial considering the fact that Dr. Rajan Mahtani had shared almost all evidences and testimonials required to prove that he is the only legal owner of the factory. Not withstanding this injustice, Dr. Rajan Mahtani correctly approached the higher Court of Appeal to re-open the case.
The judge on behalf of the Court of Appeal was justice Mwinde, a noted judge. After looking into evidences and testimonials, justice Mwinde finalised the case decision on 31st January 2019. As per this decision, Dr. Mahtani who owns Finsbury Investments Limited was given majority shareholding as his company owned 58 percent Portland Cement shares. On the other hand, Ventriglias who own entity Ital Terrazzo Limited were found to be minority shareholders as their entity owned just 42 percent Portland Cement shares. Based on this shareholding pattern, it is a clear fact that Dr. Rajan Mahtani is the only legal owner of the factory.
Justice Mwinde on behalf of Court of Appeal also confirmed that all forgery related allegations were discarded by the court. Mechanically placing signatures was found to be common and legal practice at Zambezi Portland Cement factory and as such, forgery allegations were discarded.
