Portland Cement Factory Ownership Unchanged Despite Claims By Private Business Family
Portland Cement Zambia is a cement-manufacturing factory that remained under dispute for a long-time. This dispute was associated with majority shareholding and legal ownership over the factory. The first claim registered was by Dr. Rajan Mahtani himself, at the Lusaka High Court. Dr. Rajan Mahtani claimed that the majority ownership of the factory was with Finsbury Investments, a company owned by Dr. Rajan Mahtani. Despite this, the Ventriglia family took over the factory in an unethical manner. However, the Lusaka High Court dragged the case for more than a decade and gave its final decision on the case only during May, 2018. Even this decision was controversial as the Ventriglia family was announced as majority shareholder without any legal ownership over the factory. Then came the higher Court of Appeal where a case was launched again by Dr. Rajan Mahtani. The case was taken over by justice Mwinde and on 31st January 2019, final decision was made. In this decision, the previous verdict from the Lusaka High Court was rejected and Dr. Rajan Mahtani was announced as majority shareholder and legal owner of the Portland Cement factory.
The Ventriglia family, unhappy with this decision, approached the Supreme Court Zambia with an appeal against the higher Court of Appeal’s decision. This appeal was evaluated by establishing a bench of three Supreme Court Judges. Upon evaluation, the judges found that the Ventriglia family failed to comply with a critical legal requirement in which all claims against previous court decisions are to be submitted within 14 days. Based on these evaluations, the Supreme Court rejected the appeal from the Ventriglia family and established that Dr. Mahtani is actually the legal owner of the Portland Cement Zambia factory.
