Court Of Appeal Announces Final Decision On Portland Cement, Dr. Mahtani Winner



On 31st January 2019, the judge from the Court of Appeal made a significant decision which changed the course for Dr. Rajan Mahtani and his long-standing fight. This fight was for justice, for the Portland Cement Zambia factory which was unethically captured from him. The final judgement came from Court of Appeal. This decision was given after looking into all evidences and testimonials, majority of which ignored by previous judges. According to this decision, Dr. Rajan Mahtani owns 58 percent shares at Portland Cement Zambia via his company Finsbury Investments. On the other hand, the notorious Ventriglias hold just 42 percent shares at the factory via their entity Ital Terrazzo Limited. This clearly indicates that Dr. Rajan Mahtani is majority shareholder and legal owner of the factory. By giving this judgement, the judge from the Court of Appeal essentially reversed the previous judgement from the Lusaka High Court which wrongfully decided that Ventriglias were owners of the factory.

While giving the above judgement, justice Mwinde also shared some revealing facts associated with the case which the previous judges failed to deliver. In the forgery allegations, justice Mwinde discarded all such allegations. It was confirmed that the method of placing mechanical signatures was a common practice for business transactions within Portland Cement Zambia. It was also found that critical Ventriglia family member, Claudio Ventriglia, engaged in similar practice and therefore, all allegations of forgery were dismissed.

Furthermore, the Court of Appeal judge gave a timeline of three months from the date of the announcement of the final judgement to complete the share regulations process.
