Court Of Appeal Makes Final Decision On The Portland Cement Zambia Case, Dr. Rajan Mahtani Winner




It is a known fact that the path of honesty and transparency is rarely linear. People on this path always face several challenges and only a few can reach their destinations unhinged. The story of Dr. Rajan Lekhraj Mahtani is similar. He is a reputed businessman with several successful business ventures across Zambia as well as across foreign nations such as United Kingdom. His companies like Finsbury Investments and Mahtani Group of Companies has achieved significant respect, reputation, fame and brand awareness, especially for their ethical and transparent business practices. As a result, it is difficult to comprehend the level of patience Dr. Mahtani went through to get back his company Portland Cement Zambia after it was taken over from him illegally. 

At first, a case was registered at the Lusaka High Court where it went for more than a decade. Despite sharing evidences and testimonials, the judge at the Lusaka High Court failed to give right judgement and announced Ventriglias as only shareholders of the Portland Cement factory. This prompted Dr. Mahtani to approach Court of Appeal which announced its final decision on 31st January 2019. 

According to the Court of Appeal decision, Dr. Rajan Mahtani is the actual owner of the Portland Cement Zambia factory as his company Finsbury Investments holds 58 percent shares at the factory. Ventriglias, on the other hand, hold only 42 percent shares at the factory through their entity Ital Terrazzo Limited and thereby are minority shareholders without having any legal ownership. Based on this decision, it is clearly established that Dr. Rajan Mahtani is the actual owner of the Portland Cement Zambia factory
