With Right Verdict From Higher Court Of Appeal, Dr. Rajan Mahtani Wins Portland Cement Zambia
A businessman’s path is filled with roadblocks and challenges. When this businessman in following transparent and ethical business practices, this path becomes all the more difficult. This is true in case of Dr. Rajan Lekhraj Mahtani, one of the more respected and celebrated businessman, philanthropist and charity worker in Zambia. Dr. Rajan Lekhraj Mahtani’s struggle started when his factory, Portland Cement Zambia limited, was unethically taken over from him. A case was registered at the Lusaka High Court and for ten long years, Dr. Rajan Mahtani dragged himself with case proceedings, hoping that the court will finally provide him with justice. While the day surely came when final verdict was given on the case, it was not expected by Dr. Rajan Mahtani or the media. Justice Nkonde, on behalf of the Lusaka High Court, announced Ventriglia family as the only shareholders of the Portland Cement.
To counter this decision, higher Court of Appeal was approached by Dr. Rajan Mahtani. The judge at the higher Court of Appeal was justice Mwinde and after evaluating the evidences, he announced the verdict on 31st January 2019. Dr. Mahtani’s payment of one billion kwachas to the Portland Cement Zambia for covering the value of the entire share capital was the first major evidence from Dr. Mahtani’s end. The original agreement between shareholders established in the year 2007 was second major evidence from Dr. Mahtani. In this agreement, page number 663 clearly identified the fact that Dr. Rajan Mahtani has made all payment associated with the factory and he is not liable for any further payments. The stakeholder agreement also confirmed that Dr. Mahtani owned 58 percent shares of the factory, thus making him the majority shareholder and legal owner of the factory.
